Amazon sellers are turning to the courts to challenge the operational practices of the world’s largest online retailer, accusing it of imposing excessive demands on its marketplace sellers.
Last week, Ecom Authority, along with 595 other Amazon sellers, filed a lawsuit against Amazon in the U.S. District Court in Miami. The suit alleges that Amazon’s business practices are unlawful, citing the following grievances:
- Arbitrary suspension of seller accounts
- Freezing of sellers’ inventory
- Charging deactivated accounts for storage, removal, and disposal of inventory
- Limited options for sellers to appeal or rectify account suspensions.
The lawsuit claims these practices have resulted in millions of dollars in direct financial losses, with total damages estimated at $30 million. Additionally, the suit argues that a favorable ruling could pave the way for third-party sellers to challenge Amazon’s arbitration requirements.
The coalition is seeking compensation for the financial harm they allege was caused by Amazon’s actions and is calling for reforms to address what they describe as systemic inequalities within the marketplace. According to a post on Amazonsellers.attorney, the plaintiffs hope to achieve greater transparency and fairness in Amazon’s policies.
“If the plaintiffs succeed, Amazon may be required to overhaul policies that currently prioritize its own products over those of third-party sellers,” the post noted. This could include providing clearer explanations for account suspensions and offering sellers more opportunities to appeal decisions.
According to Law.com, the lawsuit asserts that $30 million in damages has been accrued over the past eight months due to what the plaintiffs describe as unjust account suspensions and inventory freezes.
“Amazon’s conduct is not only heavy-handed but also shrouded in opacity, relying on vague allegations of fraud and misconduct without credible evidence,” the complaint states. “Amazon has leveraged its platform dominance to freeze our clients’ funds, dispose of their inventory, and disrupt their livelihoods, all while denying them any meaningful avenue for recourse.”
